1. General
By booking a session with Lisa Katrina Photography, you agree to the following Terms and Conditions. These terms form a binding agreement between you (“the Client”) and me, Lisa Pont, trading as Lisa Katrina Photography (“the Photographer”).
2. Booking, Payment and Cancellations
A non-refundable retainer is required at the time of booking to secure your session date.
The remaining balance must be paid by the due date listed on your invoice.
Your booking is confirmed only once both the retainer and signed contract have been received.
If you cancel your session, the retainer is non-refundable but may be transferred to a new date at my discretion.
If illness, severe weather, or unforeseen circumstances arise, I’ll work with you to reschedule at the earliest suitable time.
3. Reschedules and Force Majeure
If I am unable to attend due to illness, accident, family emergency, or any event beyond my control, I will make every reasonable effort to reschedule or arrange for another professional photographer of comparable style and standard to step in. If rescheduling is not possible, any payments (excluding the non-refundable retainer) will be refunded in full.
4. Image Copyright and Usage
I retain full copyright and moral rights over all images created.
You are granted a personal licence to download, print, and share your images for personal use only.
Images must not be edited, altered, sold, or used for commercial purposes without my written consent.
I may use selected images for my portfolio, website, or marketing materials unless you request otherwise in writing before your session.
5. Client Responsibilities
You are responsible for:
Arriving on time and being prepared for your session.
Ensuring all necessary permissions are obtained for the chosen location.
Supervising children and pets at all times during the session.
I am not liable for missed shots due to lateness, location restrictions, or client non-compliance.
6. Editing and Delivery
Standard editing includes colour correction, tonal adjustments, and artistic enhancement consistent with my style.
Additional or specific retouching requests may attract an additional fee.
Final galleries are delivered via Pic-Time within approximately 3–4 weeks (unless otherwise advised).
Galleries remain available for a minimum of 60 days from delivery. It is your responsibility to download and back up your images during this period.
7. Limitation of Liability
While I take all reasonable care in capturing and storing your images, my liability for loss, damage, or failure to deliver for any reason shall be limited to the amount paid for the session. I am not responsible for events beyond my control, such as technical failure, extreme weather, or unforeseen circumstances.
8. Refunds
Refunds are only issued where required by Australian Consumer Law. If you are dissatisfied with your images, please contact me within seven (7) days of gallery delivery so that any concerns can be discussed and resolved where possible.
9. Copyright and Website Content
All photographs, videos, text, and other content displayed on this website are the intellectual property of Lisa Pont trading as Lisa Katrina Photography and are protected under the Copyright Act 1968 (Cth).
No part of this website, including but not limited to images, written material, or design elements, may be copied, reproduced, distributed, altered, or used in any form without express written permission from Lisa Katrina Photography.
Unauthorised use or reproduction of any images or content is a breach of Australian copyright law and may result in legal action.
10. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the jurisdiction of the courts of New South Wales.
